In DUI case law news, the Pennsylvania Superior Court issued a decision in the case of a York County man who drank gasoline and tar remover in an attempt to commit suicide.
The defendant was not drinking alcohol, but was found guilty of
driving under the influence of drugs, even though gasoline and tar
remover may not commonly be considered drugs. The fact that the
defendant testified as to the effect that the effects of the gasoline
and tar remover were similar to drug-induced effects allowed the
Superior Court to uphold the conviction at the trial court level.
The entire text of the decision can be found here. The case (Comm. v. Roser) is docketed at 2006 Pa. Super 365.
