Attorney Urey wins jury trial on conspiracy and access device fraud charges PDF Print E-mail

Client charged with access device fraud and criminal conspiracy. Following much procedural wrangling, including pretrial motions, a jury trial was held on April 10, 2007. Attorney Jason Urey of Gothie Van Allen LLC tried this case. The case involved an individual accused of using another person A's ATM card, which was allegedly given to him to use by person B. Person B had entered a guilty plea and testified that defendant was not involved. Security camera footage was shown, allegedly showing that defendant was the only person in the ATM booth at the time of the transaction.

Thorough investigation by defense counsel prior to trial revealed that the bank withdrawal time records and the security camera time stamps were not synchronized and that defendant was in the ATM to make a legitimate transaction immediately after Person B had left the ATM booth. Bank security staff did not secure photos for the entire timespan covering both sets of transactions. Despite many efforts made at pretrial proceedings to point out the deficiencies in the Commonwealth's evidence, the charges were not dropped and the trial was held.

The defendant found not guilty on all counts, and walked away a free man.

Conte, 1805 M.D.A. 2006, the Pennsylvania Superior Court ruled on August 2, 2007, that an officer who approaches a disabled vehicle alongside the road and who activates the overhead lights and approaches the apparent driver does not "seize" the driver for purposes of the Pennsylvania or United States constitutions.
