| Felony drug case overturned on appeal |

Client was charged with Possession with Intent to Deliver (PWID). Essentially, client was accused of (1) being a drug courier and (2) sharing drugs with a friend, but not selling them. Following a trial, client was acquitted on the drug courier aspect of the case but convicted of the PWID because the jury determined that client shared drugs with a companion. The trial judge ruled that the client was permitted to remain free on bail pending appeal. The Superior Court panel determined that the initial motor vehicle stop that the police made of client's car was illegal, and that the evidence obtained from the stop should be suppressed. Without the evidence obtained illegally as a result of the motor vehicle stop, the Commonwealth's case was gutted.
The client was facing a sentence of 1-2 years in a state prison. That sentence was vacated. Client did not serve any time beyond that which she spent in prison prior to bail being set.The case is docketed here. |
