PA Supreme Court: multiple 'first' offenses allowed PDF Print E-mail
In a decision published on October 23, 2009, in the case of Comm. v. Haag , the Pennsylvania Supreme Court ruled that a defendant is not subject to a mandatory sentence as a second offender where his two DUI charges occurred on the same night within hours of each other. This apparently overturns a number of Pennsylvania Superior Court cases to the contrary, including Comm. v. Nieves.
