PA DUI Penalties - Overview PDF Print E-mail

Penalties for DUI in Pennsylvania fall into three major categories (called "tiers"), depending on the Blood Alcohol Content ("BAC") that it determined when a driver is tested for alcohol. There are also situations where a BAC test result is not obtained because a driver refuses chemical testing or where no testing is done for some reason. Commercial drivers and minors (a "minor" under the DUI law is someone under 21 years of age) also present unique sentencing questions. Click on the appropriate link below to see what the basic penalties might be under your circumstances as you best understand them.

It is important to note that sentencing for DUI in York has developed in a way that allows for some jail time to be served on house arrest instead of in jail. You may also qualify for "outmate" (more  commonly known as "work release"). You may also be eligible for ARD, which would let you avoid jail time and serve a greatly reduced license suspension, possibly even avoiding a license suspension. You may be eligible for ARD even if you have had a prior DUI. You may also be able (to a limited degree) to speed up or put off the date you begin to serve your sentence, if you do have to serve one. This can be important for work-related or personal reasons.

For the above reasons, you should call attorney Joseph N. Gothie, Esq., at (717) 848-8455 to discuss your DUI case during a free, confidential, no-risk consultation.
