There are standard rules (terms and conditions) that all ARD applicants must follow while participating in the ARD program in York County, Pennsylvania. There may be some rules that will be imposed in a specific case (such as a letter of apology to a victim, payment of restitution, varying amounts of community service, etc.). The following is a list of the standard conditions that are almost always applied to every case. Since special terms can be applied to individual cases, do not assume that the following list of conditions is everything that you will have to do. You might have to do more things. Also, if you have a DUI, you will have special terms and conditions as well as possibly a shorter time to serve in ARD.

Standard ARD Rules:

1.  Be on good behavior and do not violate any laws, including traffic laws and regulations. Report any arrest to the York County Probation Department within 3 days.
2. Report to the York County Probation office as directed.
3. Do not use illegal drugs.
4. Comply with drug testing.
5. Avoid the excessive use of alchol (greater than .05%). (This requirement may be to avoid alcohol altogether under some circumstances).
6. Comply with breath testing for alcohol.
7. Pay court costs and ARD program fees.
8. Pay restitution (if appropriate).
9. Maintain employment (may be waived in disability or student cases).
10. Report changes in employment to the Probation Officer within 72 hours.
11. Report any changes in residence to the Probation Department within 72 hours.
12. Do not furnish false statements to your Probation Officer.
13. Do not engage in any assaultive/threatening behavior towards anyone.
14. Do not possess, control or use firearms or any deadly or illegal weapons.
15. Do not move your residence or travel outside of York County without permission from the Probation Officer. (This can be modified for those who work or live outside of York County, so that someone from Lancaster, for example, can participate in ARD).
