The penalties you may face for a DUI in Pennsylvania where your Blood Alcohol Content ("BAC") is .08 or higher up to, but not including .10 are as follows, depending on how many offenses you have had in the prior ten years:

No prior DUI offenses

  • ungraded misdemeanor
  • up to 6 months probation
  • $300 fine
  • alcohol highway safety school
  • treatment when ordered

1 prior DUI offense

  • ungraded misdemeanor
  • 12 month license suspension
  • 5 days to 6 months jail time
  • $300 to $2,500 fine
  • alcohol highway safety school
  • treatment when ordered
  • 1 year ignition interlock

2 or more prior DUI offenses

  • 2nd degree misdemeanor
  • 12 month license suspension
  • 10 days to 2 years prison
  • $500 to $5,000 fine
  • treatment when ordered
  • 1 year ignition interlock

Your penalty in York County may be somewhat different. For instance, you may be able to serve some of your sentence on house arrest, though since there is no mandatory jail time for a first offense and the jail time for a second offense is minimal, house arrest is not really a very good option.

In addition, for the first offense, you may possibly want to consider ARD as an option.
