The Occupational Limited License (an "OLL") (also known informally as a "bread and butter" license) is sometimes available to DUI offenders. Since one of the most significant penalties for DUI is the loss of license, an OLL is generally not available to DUI offenders. Under certain circumstances, however, it is available, but there are significant limitations.

You may apply for an OLL to let you drive during a DUI suspension only if you have served at least sixty days of your DUI suspension AND if the DUI is your first offense. It is important to remember that DUI for first offenders in the first tier does not include suspension of license as a penalty. So that leaves only second and third tier first time offenders as people eligible for an OLL.

First time offenders in tier 2 and tier 3 penalty sections of the DUI statue face a 12 month suspension for the DUI offense. If people in those categories apply for and are accepted into ARD, a second tier offender gets a regular license after a 30 day suspension and and a third tier offender gets a regular license after a 60 ay suspension, so ARD is clearly a better option than an OLL.

This means that the only people who really benefit from an OLL are people who are not eligible for ARD for some reason who are second or third tier first-time offenders OR people who have no more than one prior DUI who are ineligible for ARD. It gets complicated quickly, especially if you have situations such as a DUI charge that is a refusal case, resulting in multiple suspensions.
