Defendant was involved in a two-car accident and charged with DUI. The other driver was also charged with DUI. There was a dispute as to how long it was between the accident, relinquishing control of the vehicle by client, and the blood test at Gettysburg Hospital. The DUI charged was the client's second within ten years, and the BAC made the offense a second tier DUI charge.

A compromise agreement was worked out allowing client to enter a plea to a first tier DUI charge instead of a second tier DUI. Instead of facing thirty days in jail, client was able to do a five day sentence. Client's fine was also significantly lower.
